A regular client contacted us with a problem in relations with the state tax service authorities regarding the unblocking of tax invoices. The Fiscal Service Commission blocked the registration of tax invoices in the Unified Register of Tax Invoices, which created significant obstacles in its work.
An administrative appeal of the decision to refuse to register tax invoices did not lead to the desired result. And tax lawyers decided to act more radically – to prepare a lawsuit. In the legal position, they pointed out the vague wording of the grounds for stopping the registration of tax invoices, the lack of reference to specific criteria for the taxpayer’s riskiness, which was insufficient for making a decision to refuse to register tax invoices. In addition, the position was supported by documentation.
As a result, by the decision of the District Administrative Court of Kyiv dated February 26, 2020, the commission’s decision to refuse to register tax invoices was declared unlawful and canceled, and the State Tax Service of Ukraine was obliged to register them in the Unified Register of Tax Invoices.
