What to do during a tax audit

What to do during a tax audit: step-by-step instructions

A tax audit can be stressful, but knowing your rights and following the correct steps can reduce risks and help you avoid penalties. Here’s what to do in 2025:

  1. Verify the auditors’ credentials
At least two tax officials must present valid documents, including audit orders and IDs.
  2. Check the legal basis
Request the official audit order. No notice is required for factual audits, but documentation is a must.
  3. Stay calm
Confidence and composure ensure better communication.
  4. Provide only the requested documents
No originals, only certified copies. Don’t give documents unrelated to the audit.
  5. Record everything
Keep a journal of actions and responses. Involve a lawyer or accountant if possible.
  6. Communicate in writing
Respond to queries in writing whenever possible.
  7. Know your rights
Auditors cannot seize originals without a court order. You have the right not to testify against yourself (Art. 63 of the Constitution of Ukraine).
  8. Train your staff
Ensure employees know how to act. Do not obstruct the audit, but do not over-cooperate.
  9. Appeal any violations
Document any misconduct and use it in your appeal.
  10. Consult professionals
Engage a tax lawyer early to protect your interests.
